You must be at least 13 years old to use EuropeTracks. If you are between 13 and 18 years old, you confirm that you have obtained parental or guardian consent to use the Platform and agree to these Terms.

If you are under 13, you are not permitted to use this Platform under any circumstances. We do not knowingly collect personal data from children under 13.

To access certain features, you must create an account. When registering, you agree to:

• •Provide accurate, current, and complete information
• •Maintain and promptly update your account details
• •Keep your password secure and confidential
• •Notify us immediately of any unauthorised use of your account
• •Be responsible for all activity that occurs under your account

You are solely responsible for maintaining the confidentiality of your login credentials. EuropeTracks is not liable for any loss or damage arising from your failure to keep your account secure. We will never ask for your password via email, message, or any other communication.

Each user may only maintain one active account. Creating multiple accounts to circumvent bans, limitations, or community guidelines is strictly prohibited and may result in all accounts being suspended.

EuropeTracks grants you a personal, non-exclusive, non-transferable, limited licence to access and use the Platform for your own personal, non-commercial purposes in accordance with these Terms.

You agree not to:

• •Use the Platform for any unlawful purpose or in violation of any regulations
• •Post false, misleading, defamatory, obscene, or harmful content
• •Impersonate any person or entity, or misrepresent your affiliation
• •Submit fake, inaccurate, or deliberately misleading track information
• •Harvest or scrape user data, track data, or any other Platform content
• •Attempt to gain unauthorised access to any part of the Platform or its systems
• •Interfere with, disrupt, or overburden our servers or infrastructure
• •Use automated bots, crawlers, or scripts to interact with the Platform
• •Reproduce, duplicate, sell, or exploit any part of the Platform without our written permission
• •Reverse-engineer, decompile, or disassemble any part of the Platform
• •Upload or transmit viruses, malware, or any other harmful code
• •Promote dangerous or illegal off-road riding behaviour
• •Engage in harassment, abuse, or hate speech directed at any user or group

EuropeTracks is an informational platform only. We do not organise, endorse, or supervise any riding activities. You acknowledge that:

• •Motocross and off-road riding are inherently dangerous activities
• •You participate in any riding activity entirely at your own risk
• •You are responsible for ensuring you have appropriate insurance, equipment, and training
• •Track information on our Platform may be out of date — always verify conditions directly with the track before visiting
• •We are not responsible for any injury, death, property damage, or other loss arising from your use of track information or riding activities

The Platform allows you to submit content including track reviews, notes, photos, session logs, and track updates ("User Content"). You retain ownership of your User Content, but by submitting it you grant EuropeTracks a worldwide, royalty-free, non-exclusive licence to use, display, reproduce, modify, and distribute your content within the Platform and for promotional purposes related to the Platform.

All User Content must:

• •Be accurate and truthful to the best of your knowledge
• •Be relevant to the track or topic it relates to
• •Not infringe the intellectual property rights of any third party
• •Not contain personal attacks, hate speech, or discriminatory language
• •Not contain spam, advertising, or unsolicited promotional material
• •Not contain nudity, graphic violence, or other inappropriate content
• •Not include personal information about other individuals without their consent

We reserve the right (but not the obligation) to review, moderate, edit, or remove any User Content at our sole discretion, including content that violates these Terms or our community standards. We use automated tools and human review to maintain content quality. Removal of content does not imply liability on our part.

When you submit a new track, you confirm that the information provided is accurate to the best of your knowledge. Deliberate submission of false track information may result in account suspension. We reserve the right to approve, modify, or reject any track submission.

By submitting photos, you confirm that:

• •You own or have the right to share the photos
• •The photos do not infringe on any third-party intellectual property or privacy rights
• •You grant EuropeTracks the right to display approved photos publicly on the Platform

The EuropeTracks name, logo, design, software, and all Platform content (excluding User Content) are the intellectual property of EuropeTracks and are protected by copyright, trademark, and other applicable laws. You may not use, copy, or reproduce any of our intellectual property without our prior written consent.

The Platform incorporates map data and tile services from third-party providers (including OpenStreetMap contributors, CartoDB/CARTO, and Esri/ArcGIS). These are subject to their own licences and terms of use. Track logos and club imagery remain the property of their respective owners.

If you provide us with feedback, suggestions, or ideas about the Platform, you grant us the right to use this feedback without restriction or compensation to you.

Core features of EuropeTracks are provided free of charge, including track discovery, map access, and basic community features.

We may introduce optional premium features or subscriptions in the future. Any paid features will be clearly labelled with pricing before purchase. Applicable taxes may vary by region.

If any in-app purchases become available through the Apple App Store or Google Play, they are subject to the respective platform's terms of purchase and refund policies. EuropeTracks does not control refund decisions made by Apple or Google for purchases made through their platforms.

The Platform is provided on an "as is" and "as available" basis without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement.

EuropeTracks expressly disclaims all liability for any injury, death, property damage, or other loss arising from or in connection with any riding activity, regardless of whether such activity is discovered through or facilitated by the Platform. Motocross and off-road riding carry serious risks — you accept these risks entirely by participating.

To the fullest extent permitted by applicable law, EuropeTracks and its officers, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• •Loss of profits, revenue, or data
• •Loss of use or business interruption
• •Damages arising from reliance on inaccurate track information
• •Unauthorised access to or alteration of your content or data
• •Any other matter arising from your use of the Platform

Our total cumulative liability to you for any claim arising out of or relating to these Terms or the Platform shall not exceed the greater of £50 GBP or the amount you have paid to us in the 12 months preceding the claim.

We do not guarantee that the Platform will be available at all times. We may experience downtime for maintenance, upgrades, or due to circumstances beyond our control. We are not liable for any loss arising from Platform unavailability.

You may stop using the Platform at any time. You may delete your account from within the app settings or by contacting us at info@europetracks.com. Upon account deletion, your personal data will be handled in accordance with our Privacy Policy.

We reserve the right to suspend or permanently terminate your account at our sole discretion, with or without notice, if we believe you have:

• •Violated these Terms or our community standards
• •Provided false registration information
• •Engaged in fraudulent or abusive behaviour
• •Endangered the safety or experience of other users
• •Misused club manager or operator permissions

Upon termination, your right to access the Platform ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property rights, disclaimers, indemnification, and limitations of liability) shall continue to apply.

• •These Terms are between you and EuropeTracks only — not Apple Inc.
• •Apple has no obligation to provide maintenance or support for the app
• •Apple is not responsible for any claims relating to the app or your use of it
• •Apple is a third-party beneficiary of these Terms and may enforce them against you
• •You confirm you are not located in a country subject to a US Government embargo or on a US Government prohibited persons list
• •In the event of any conflict between these Terms and the Apple Media Services Terms and Conditions, these Terms govern to the extent permitted

• •These Terms are between you and EuropeTracks only — not Google LLC
• •Google has no obligation to provide maintenance or support for the app
• •Google is not responsible for any claims relating to the app or your use of it
• •Your use of the app is also subject to the Google Play Terms of Service
